1. Acceptance
These Terms & Conditions govern your use of this website and the charter arrangement services provided by ExcelJet ("ExcelJet", "we", "us"). By using this website, submitting an enquiry, or confirming a charter, you agree to these terms.
Where you book on behalf of others, you confirm that you have authority to accept these terms for every passenger in your party and that you will make them aware of the relevant provisions.
2. Our Role
ExcelJet arranges air charter services as an agent, sourcing aircraft from third-party air operators who hold the applicable Air Operator Certificate and who act as the carrier for your flight. Unless we state otherwise in writing for a specific booking, ExcelJet is not the carrier and does not operate the aircraft.
The carriage itself is governed by the operator's conditions of carriage and by the applicable international conventions and national law. Those documents are available on request and take precedence over these terms in relation to the carriage.
In short: we select, arrange and manage the charter on your behalf; a licensed operator flies it. Safety decisions on the day rest with that operator and its pilot-in-command.
3. Quotations
- Quotations are indicative and subject to aircraft availability at the time of confirmation.
- Prices are valid for the period stated on the quotation and may change if the itinerary, timings, passenger numbers or baggage load change.
- Unless expressly stated, a quotation excludes de-icing, extended ground waiting, additional crew duty, unscheduled overnight costs, and charges arising from delays outside the operator's control.
- Applicable taxes, government levies and airport charges are set out in the quotation.
4. Bookings
A booking is confirmed only when we issue a written charter confirmation or charter agreement and receive the funds specified in it. Submitting the website enquiry form, or receiving a quotation, does not create a booking and does not reserve an aircraft.
The specific aircraft named in a confirmation may be substituted by the operator for another of equivalent or superior type where operationally necessary. We will inform you as soon as we are told.
5. Payment
- Payment terms, including any deposit and the balance due date, are set out in the charter agreement for each booking.
- Full cleared funds are normally required before departure. We reserve the right to withhold release of the flight where payment has not been received.
- Bank charges, currency conversion costs and any applicable withholding are for your account unless agreed otherwise in writing.
- Additional charges incurred during the trip — extended waiting, itinerary changes, additional catering or ground services — are invoiced after the flight.
Payment security. We will never request card numbers, CVV codes, net-banking credentials or OTPs by email, chat or web form. Always verify bank details by telephone using a number published on this website before transferring funds.
6. Your Obligations
You are responsible for:
- providing accurate passenger details, including full names as they appear on travel documents, by the deadline we specify;
- ensuring every passenger holds valid passports, visas, permits and any health documentation required for the itinerary;
- arriving at the airport by the reporting time notified to you;
- declaring any dangerous goods, weapons, live animals, medical equipment or unusual items before departure; and
- ensuring passengers comply with crew instructions and applicable law.
We are not liable for costs arising from incorrect or late passenger information, or from a passenger being refused travel or entry due to inadequate documentation.
7. Baggage & Cargo
Baggage capacity is limited by the aircraft's weight and volume constraints rather than a fixed piece allowance. Declare oversized or unusual items at the time of booking so that a suitable aircraft can be selected. The pilot-in-command may refuse to carry items that cannot be safely loaded or that are not properly declared.
For cargo charters, you warrant that the description, weight, dimensions and classification of the consignment are accurate and complete, that dangerous goods are declared and packaged in accordance with the applicable regulations, and that all export, import and customs documentation is in order.
8. Operational Control
All decisions relating to the safe conduct of a flight — including routing, fuel, weather, crew duty, load, and whether to depart at all — rest exclusively with the operator and the pilot-in-command. Neither ExcelJet nor the client may direct or override those decisions.
9. Delays & Diversions
While we work to keep every charter on schedule, flight times are not guaranteed. Delays, diversions, route changes and cancellations can arise from weather, air traffic control, airport restrictions, technical issues, crew duty limitations, permit delays and other circumstances.
Where a delay or cancellation occurs, we will use reasonable efforts to arrange an alternative aircraft or schedule. We are not liable for consequential losses such as missed meetings, onward connections, events or accommodation.
10. Cancellation
Cancellation by you, and any refund due, is governed by our Refund & Cancellation Policy together with the specific terms in your charter agreement. Charges generally increase as the departure time approaches.
We or the operator may cancel a charter where required for safety, legal or regulatory reasons, or where payment has not been received in accordance with the agreement.
11. Liability
As an arranging agent, ExcelJet's liability is limited to the exercise of reasonable care and skill in selecting and arranging the charter. Liability arising from the carriage itself rests with the operating carrier and is subject to the limits set by the applicable conventions and law.
To the fullest extent permitted by law, ExcelJet is not liable for indirect or consequential loss, including loss of profit, business, opportunity or reputation. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
12. Force Majeure
Neither party is liable for failure to perform caused by events beyond reasonable control, including but not limited to adverse weather, natural disaster, war, civil unrest, terrorism, strikes, epidemics, airspace or airport closure, government action, sanctions, and failures of air traffic control or airport infrastructure.
13. Passenger Conduct
Passengers must comply with all crew instructions and applicable aviation law. The pilot-in-command may refuse boarding to, or offload, any passenger whose condition or conduct presents a risk to the safety of the flight. Costs arising from such a refusal, from damage caused to the aircraft, or from cleaning beyond normal requirements, are recoverable from the client.
14. Website Use
This website is provided for information and enquiry purposes. Content — including aircraft specifications, capacities, ranges, indicative prices and imagery — is provided in good faith but may change and should not be relied upon as a binding representation. See our Disclaimer.

16. Governing Law
These terms are governed by the laws of India. The courts at New Delhi have exclusive jurisdiction over any dispute arising out of or in connection with them, save that we may seek injunctive relief in any competent jurisdiction.
If any provision is found unenforceable, the remainder continues in full effect. Our failure to enforce a provision is not a waiver of it.
